Welcome to QuizGenius! These Terms of Service ("Terms") govern your access to and use of our mobile application, website, and services (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Services.

1. Acceptance of Terms

By creating an account, downloading our app, or using any of our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you are under 18 years old, you must have your parent or guardian's permission to use our Services.

2. User Accounts

2.1 Account Creation

• You must provide accurate and complete information when creating an account
• You are responsible for maintaining the security of your account credentials
• You must be at least 13 years old to create an account
• One person or entity may not maintain more than one account
• You must not share your account with others

2.2 Account Responsibilities

• You are responsible for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account
• You agree to keep your contact information up to date
• You must not use another user's account without permission

2.3 Account Termination

We reserve the right to suspend or terminate your account at our discretion, including for violations of these Terms, fraudulent activity, or prolonged inactivity.

3. Acceptable Use

3.1 Permitted Use

You may use our Services for:

• Personal educational purposes
• Creating and taking quizzes and tests
• Accessing study materials and past papers
• Participating in online classes
• Collaborating with other students (where permitted)

3.2 Prohibited Conduct

You agree NOT to:

• Violate any applicable laws or regulations
• Infringe on intellectual property rights
• Upload malicious code, viruses, or harmful content
• Attempt to gain unauthorized access to our systems
• Scrape, copy, or download content without permission
• Reverse engineer or decompile our application
• Use automated tools (bots, scripts) without authorization
• Impersonate another person or entity
• Harass, threaten, or abuse other users
• Share answers or engage in academic dishonesty
• Spam or send unsolicited communications
• Use the Services for commercial purposes without authorization

4. Content and Intellectual Property

4.1 Our Content

All content provided through our Services, including quizzes, tests, study materials, AI-generated content, software, designs, and trademarks, is owned by QuizGenius or our licensors and is protected by intellectual property laws.

4.2 Your Content

When you upload or submit content (notes, quiz responses, forum posts, etc.), you:

• Retain ownership of your content
• Grant us a worldwide, non-exclusive license to use, modify, and display your content to provide our Services
• Represent that you have the right to submit the content
• Agree that your content may be visible to other users (where applicable)

4.3 Copyright Policy

We respect intellectual property rights. If you believe your copyright has been infringed, contact us at alvysamy@gmail.com with:

• Description of the copyrighted work
• Location of the infringing content
• Your contact information
• A statement of good faith belief
• A statement of accuracy under penalty of perjury

5. Payments and Subscriptions

5.1 Premium Features

Some features require payment. By purchasing a subscription or premium features, you agree to pay the applicable fees and taxes.

5.2 Billing

• Payments are processed through third-party payment processors (Razorpay, Stripe)
• All fees are in INR unless otherwise specified
• Subscriptions automatically renew unless cancelled
• You authorize us to charge your payment method for recurring payments

5.3 Refunds

• Digital content purchases are generally non-refundable
• Refunds may be granted at our discretion for technical issues
• Contact support within 7 days of purchase for refund requests
• Institute subscriptions follow separate refund policies

5.4 Cancellation

• You may cancel your subscription at any time
• Cancellation takes effect at the end of the current billing period
• No refunds for unused portions of the subscription period

6. Educational Institutions

6.1 Institute Accounts

Educational institutions using QuizGenius agree to:

• Provide accurate information about the institution
• Comply with applicable educational regulations
• Ensure proper use by instructors and students
• Maintain appropriate data privacy standards

6.2 Student Enrollment

Students enrolled through an institute agree that:

• The institute may access their academic data
• Progress and scores may be shared with instructors
• Institute policies also apply to their use of the platform

7. Third-Party Services

Our Services integrate with third-party platforms (Google Meet, Zoom, payment processors). Your use of these services is subject to their respective terms and privacy policies. We are not responsible for third-party services.

8. Disclaimers and Limitations of Liability

8.1 Service Availability

We strive to provide reliable Services, but we do not guarantee:

• Uninterrupted or error-free access
• Accuracy or completeness of content
• Specific educational outcomes or exam results
• Compatibility with all devices or platforms

8.2 "As Is" Service

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

8.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, QUIZGENIUS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

8.4 Maximum Liability

Our total liability to you for any claims arising out of or related to these Terms or the Services shall not exceed the amount you paid us in the 12 months preceding the claim.

9. Indemnification

You agree to indemnify and hold harmless QuizGenius, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, or expenses (including legal fees) arising from:

• Your use or misuse of the Services
• Your violation of these Terms
• Your violation of any third-party rights
• Your content submitted to the Services

10. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of significant changes by:

• Posting a notice in the app
• Sending an email notification
• Updating the "Last Updated" date

Your continued use of the Services after changes become effective constitutes acceptance of the updated Terms.

11. Privacy

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your information.

12. Termination

12.1 By You

You may terminate your account at any time by contacting support or using the in-app account deletion feature.

12.2 By Us

We may suspend or terminate your access immediately, without notice, for:

• Violation of these Terms
• Fraudulent or illegal activity
• Abuse of the Services or other users
• Non-payment of fees
• Prolonged inactivity

12.3 Effect of Termination

Upon termination:

• Your access to the Services will cease immediately
• We may delete your account and data (subject to retention requirements)
• You remain responsible for any outstanding fees
• Sections of these Terms that should survive termination will remain in effect

13. Dispute Resolution

13.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to conflict of law principles.

13.2 Informal Resolution

Before filing a legal claim, you agree to contact us at alvysamy@gmail.com to attempt to resolve the dispute informally.

13.3 Arbitration

Any disputes that cannot be resolved informally shall be settled through binding arbitration in accordance with Indian arbitration laws, except where prohibited by law.

14. General Provisions

14.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and QuizGenius regarding the Services.

14.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

14.3 Waiver

Our failure to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision.

14.4 Assignment

You may not transfer or assign your rights or obligations under these Terms without our written consent. We may assign our rights and obligations without restriction.

14.5 Force Majeure

We shall not be liable for any failure or delay in performing our obligations due to circumstances beyond our reasonable control, including natural disasters, war, terrorism, pandemics, or technical failures.
